Letters and Notices regarding reading of the will

To Benjamin Wright, Surrogate of the County of Jefferson

The Petition of Silas Salisbury of the town of Adams, Co. of Jefferson sheweth that he is desirous to have the last will and testament of his father, Nicholas Salisbury, decd proved as a will of real estate and that Sarah Brown, one of the heirs of said decd died leaving a number of minor heirs her surviving.
Your petitioner therefore requests that the Court will appoint some suitable person Guardian for said minor heirs to see to their interest in the premises.

At a Surrogate's Court held at the Surrogate's office in the town of Adams in the County of Jefferson on the 13th day of January, A.D. 1834 before Benjamin Wright, Surrogate Esq. Of the said County for the purpose of proving & recording the last will and testament of Nicholas Salisbury of the town of Adams in said County of Jefferson deceased, in pursuance of Chapter 6th title 1st, Article 1st, part 2 of the revised statutes of the State of New York on the Application of Smith Salisbury & Walter Webb, executors in said will named. And on the day and year aforesaid the said Smith Salisbury, Walter Webb & Silas S. Salisbury, one of the devised in said will made default - Whereupon satisfactory proof was taken before the said Surrogate of the Service of a notice or citation on all of the heirs of the said deceased according to the Revised Statutes in such case made and provided .... which said notices & proof & acknowledgment of Service was in the words & figures following to wit.
To Seneca Salisbury, Esq., one of the heirs of Nicholas Salisbury late of the town of Adams, in the County of Jefferson & State of New York, deceased. You are hereby required to take notice that we shall apply to Benjamin Wright, Surrogate of the County of Jefferson at his office in the town of Adams in the County of Jefferson on the 13th day of January next at 10 o'clock in the forenoon to have the last will and testament of Nicholas Salisbury deceased proved and recorded pursuant to the Chapter 6th, title 1st, Article 1st, part 2 of the Revised Statutes of New York.

And whereas a similar notice in all respects to the one here recorded was proved before me to have been directed to and served upon Mrs. Abigail Rudd, Edward Salisbury, Lucy L. L. Webb, Lydia Smith, Silas S. Salisbury and Wally Brown, guardian of Juliette Brown, Sarah Ann Brown, James Brown, Ellen Brown, Caroline Brown, William Brown, Maria Brown, the minor children of Sarah Brown decd.
Wherefore the following proof was taken and the following witnesses were sworn before the said Surrogate on the day & year first aforesaid & severally testified as follows to wit.

In the matter of proving the
will of the Real estate of
Nicholas Salisbury, decd. Jefferson ss, David H. Parham of the town of Adams in said County being first duly sworn depose and saith that he saw Nicholas Salisbury, late of the town of Adams in said county deceased bearing date the fifteenth day of August in the year of our Lord one thousand eight hundred & thirty three. That he heard the said Nicholas Salisbury declare the same to be his last will and testament and that he, the deponent did subscribe his name thereto as a witness at the request of the said Nicholas Salisbury and further that at the time thereof the said Nicholas Salisbury was of sound mind & memory of full age and not under any constraint and further saith not..

In the matter of proving the last will and testament of the real estate of Nicholas Salisbury deceased --
Jefferson ss;
Calvin Skinner of the town of Adams in said County being first duly sworn deposeth and saith that he saw Nicholas Salisbury deceased subscribe the instrument now shown to this deponent & which purports to be the last will and testament of Nicholas Salisbury, late of the town of Adams in said County, deceased, bearing date the fifteenth day of August in the year of our Lord one thousand eight hundred & thirty three, that he heard the said Nicholas Salisbury declare the same to be his last will and testament and that he, this deponent, did subscribe his name thereto as a witness at the request of the said Nicholas Salisbury; and further that at the time thereof, the said Nicholas Salisbury was of sound mind & memory, of full age, and not under any restraint further saith not.

The foregoing proofs and said examinations taken before me, the surrogate aforesaid, at the time & place first mentioned and the depositions of the respective witnesses were by them respectively subscribed after having been carefully read over to them. And I, the said surrogate, being satisfied upon the said proof taken that the said will was duly executed; that the said Testator at the time of executing the same, was in all respects competent to devise Real estate & not under restraint, do therefore allow the said will & examinations & proofs to be Recorded Witnesses. Benjamin Wright, Surrogate aforesaid on the day and year aforesaid.

Jefferson County: Charles Wright of the town of Adams, County of Jefferson, State of New York being duly sworn says that on the evening of the 21st day of December, inst, he deposited in the letter box of the Post office in the town of Adams in said county kept by Jason Marsh, Esq. (the Post office at the time being shut) the following letters and notices to wit - One letter involving a notice signed with the names of Walter Webb and Smith Salisbury in the usual form - notifying said Salisbury that said Webb & Smith Salisbury would apply to Benjamin Wright, Surrogate of said County of Jeffers [sic] to have the last will and testament of Nicholas Salisbury proven before said Surrogate on the 13th day of January next at 10 oclock in the forenoon, and that said letters enclosing said notices were directed on the back thereof to said Seneca Salisbury, Fredericktown in the county of Richland, Ohio. And the other letter containing a similar notice was at the same time deposited & directed to Edward Salisbury, Woodsfield, Monroe County, Ohio and a letter containing a similar notice directed to Mrs. Abigail Rudd, wife of Col. Benjamin Rudd of Western, Oneida Co., N. Y.
