Petition to open the estate was brought on 20 June 1854 by ROYAL MCNITT and NELSON MCNITT and MARY MCNITT all of Clayton.

ANDREW McNITT named GEORGE W. McCUMBER as Executor of the will. Named sons ROYAL and ADSON McNITT. Named wife, MARY McNITT. After her death, proceeds from the 50 acre farm were to go to son, ROYAL McNITT. If he should die before his wife, then profits to her as long as she remains his widow. When she ceases to be his widow, then the farm to become the property of ANDREW JASPER McNITT, son of ROYAL McNITT, on condition that Jasper pays to CLARRISSA McNITT, daughter of NELSON McNITT, 100 dollars. Will dated 8 July 1846. /s/ Andrew McNitt. Witnesses: BENJAMIN PHILLIPS of Clayton and DYER E. PIERCE, M.D., of Lyme, Jefferson Co. Will proved: 20 June 1856

NOTE: The 1850 census of Clayton shows Andrew McNitt age 68, b MA and Mary McNitt age 66 b Connecticut. The 1850 census shows Nelson McNitt, age 42, b NY; Ann McNitt, age 38 b NY: Clarissa McNitt, age 9, b NY: Frances McNitt, age 7, b NY and Dewitt McNitt, age 5, b NY. In 1850, Royal McNitt of Clayton was 46, b NY; Jane McNitt, age 35, b NY: Mary E. McNitt, age 16, b NY: Ethelbert McNitt, age 13, b NY; Lucy Jane McNitt, age 11, b NY; Minerva McNitt, age 9, b NY, Andrew J(asper) McNitt, age 7, b NY and Wellington McNitt, age 3, b NY, There is a difference in the Petition to Open the probate in the spelling of son, Nelson McNitt versus the will, which called one son Adson. It is possible there was an error in the transfer of information into the final record.
