AUSTIN BATES at the age of 37 years made his will. Named his wife, LUCY. Named his father, CALEB J. BATES. Named his brother, LORENZO BATES. Named his brother, BENJAMIN BATES. Named ALANSON COLE. Named AUSTIN COLE. Named CHARLES STARKS. Named ORRIN BATES, his brother. Named ALLEN BATES, son of ORRIN BATES. Mentioned the sons of HORACE COLE but not by name. Appointed JESSE SMITH of Philadelphia and ALEXANDER SALSBURY of Alexandria as executors of the will. Will dated 22 January 1839. /s/ Austin Bates Witnesses: BERNARD BAGLEY and GEORGE A. BAGLEY, both of Pamelia, Jefferson Co.
CODICIL: Austin Bates made alterations; directed that she should receive additional money Increased the amount of money to Charles Starks. Payment to George A. Bagley a sum; to his brother, Bernard B. Bagley, a sum. Codicil added 25 May 1841. Witnesses: Bernard Bagley and ALBERT BUTTERFIELD of LeRay.
CODICIL 2: Austin Bates then of Newport, Herkimer Co., revoked the bequests to CHARLES STARKS. All sums formerly to Charles were to be given instead to wife, Lucy.
