DANIEL COMSTOCK ESTATE

In the matter of the estate of DANIEL COMSTOCK of LeRay, Jefferson Co., NY:

The Petition of ANN M. COMSTOCK town of LeRay in the County of Jefferson respectfully sheweth: that your petitioner is the widow of DANIEL COMSTOCK late of the town of LeRay in Jefferson County...that the deceased died on or about the fourth day of April 1858...that the deceased left your petitioner his widow, that he left the following kindred, to wit:

ABI COMSTOCK, LEVI COMSTOCK, GEORGE COMSTOCK of Greenfield in the County of Saratoga, mother and brothers of the deceased. MARY A. COMSTOCK of Greenfield aforesaid, niece of the deceased and only child of CYRUS COMSTOCK, deceased, who was a brother of the deceased; MARY COMSTOCK, MARIA COMSTOCK, SALOME and CORA COMSTOCK, only children of the deceased and residing with him, died on the same fourth day of April 1858 but the said children or some of them survived the said deceased as your petitioner is informed and believes...GEORGE GARDNER of the said town of LeRay in the said County of Jefferson may be joined with her in the same...6 April 1858 /s/ Ann M. Comstock

On 9 April 1858, George Gardner filed a notice with the Surrogate Court to the effect that the widow, Ann Comstock was sick at the city of Auburn, NY (Cayuga Co.) at the time of the fire.

In another communication addressed to the Surrogate Court in Jefferson:

The petition of EMMOR K. GARDNER, of the town of LeRay, in said county respectfully showeth That he is a brother and one of the next of kin of ANN M. COON, late ANN M. COMSTOCK, of said town and county. The said Ann M. on the ninth day of April 1858 being the widow and sole heir of DANIEL COMSTOCK, late of said town of LeRay, deceased,...was duly appointed administratrix of the goods, chattels and credits of the said Daniel Comstock..and George Gardner, also of said town of LeRay was joined with her in such administration...to the said ANN M. COMSTOCK, now ANN M. COON and George Gardner...on the 29th day of December 1859 the said Ann M. Comstock intermarried with DANIEL COON, a resident of said county ..and now is the lawful wife of the said DANIEL COON.../s/ EMMOR K. GARDNER 14 December 1860

NOTE: The house burned down with Daniel and children inside. A fairly involved battle for the property ensued between Daniel's family, and survivor, Ann M. Coon, as the property had been given to Daniel by his father.
