DEBORAH SPENCER, his widow, of Watertown petitioned to open probate on 1 April 1859 as one of the executors of the will. Hannah E. Mallory of Watertown, named as an executor in the will, renounced her appointment on 15 Sept. 1859.

GEORGE E. SPENCER, his son who resides at Spirit Lake, Dickerson Co., Iowa
all of full age.

GORDON SPENCER named his wife, DEBORAH, and his wife's sister, HANNAH E. MALLERY. Named JULIA A. SPENCER, wife of son, AMBROSE H. SPENCER. Mentioned the children of Ambrose and Julia but not by name. The house that Gordon left to Julia was occupied by the widow of JAMES SMITH, who was deceased. Named son GUSTAVUS M. SPENCER. Named son HENRY G. P. SPENCER to receive all surgical instruments and medical library. Named son GEORGE E. SPENCER when 21. Named wife, DEBORAH, and HANNAH E. MALLERY as co-executors. Will dated 3 Feb. 1859. /s/ Gordon P. NOTE: Widow, DEBORAH SPENCER, deceased on 5 September 1868 and upon her death, her sister, HANNAH E. MALLORY, retracted her renunciation to act as an administrator. On the 30th of November 1881, the surrogate judge discovered that Letters of Administration had not been granted to Hannah E. Mallory so letters were granted and in effect retroactively. See will of Amos Mallery this site for further information on Deborah and Hannah E. Mallery.
