On 10 September 1847, OREN A. McCUMBER of Ellisburgh, filed a petition to open probate. He stated that James had deceased and left a will. James had appointed MERCY McCUMBER as sole executrix.

ALBERT McCUMBER both of Belvidere, Boon Co., Illinois
DALLAS McCUMBER, all minors under the age of 21 years; Charles and Mercy being residents of Ellisburgh and James and Dallas of Belvidere. Minors having no general guardian within the state.

JAMES McCUMBER named his wife, MERCY McCUMBER. Named his son, GEORGE McCUMBER. Named his daughter, HARRIET McCUMBER. Named his daughter, BETSEY WILLIAMS. Named the heirs of his son, CALVIN McCUMBER who was deceased. Named heirs of his son, MARQUIS McCUMBER, who was deceased. Named his son, ALBERT McCUMBER. Named his son, OREN A. McCUMBER.
