JONATHAN TREADWAY made his will at age 76. Named his son, BENJAMIN, who was about 49 years of age. Named his son, CHRISTOPHER TREADWAY. Named his son, WILLIAM P. TREADWAY. Named his son, MOSES TREADWAY. Named his daughter, SUSANNAH, who was intermarried with SALMON S. STEPHENS. Named his daughter, SALLY MARIA. Named his son, JONATHAN FRANKLIN TREADWAY. Named his children; BENJAMIN TREADWAY, CHRISTOPHER TREADWAY, WILLIAM P. TREADWAY, MOSES TREADWAY, SUSANNAH STEVENS and SALLY MARIA TREADWAY. Appointed ASA CLARK, JR. of Rutland as sole executor. Will dated 22 November 1849.

NOTE; There was a lengthy discussion in the testimony at the proving of the will that referred to a codicil, which was not attached to the will. During the testimony, the attorney who drew up the will appeared before the court. It was further learned that before the testator's death, he deeded real estate to one of his children which, by its execution and filing, the court decided by statute did make the codicil null and void.
