On 12 July 1841, MARIAH STAGE of Theresa, filed a petition to open probate. She stated that Nicholas had lately died and left a will and she had been named executor in the will.

CHARLES WAFFLE, a minor of Victory in Cayuga County.
NICHOLAS STAGE, a minor of Theresa, having no general guardian; GEORGE A. GATES of Watertown, appointed guardian of Charles Waffle and Nicholas Stage.
WILL OF NICHOLAS STAGE
NICHOLAS STAGE named his wife, MARIA. Names his sons: HENRY STAGE and NICHOLAS STAGE. Mentioned the two heirs of his eldest daughter, late of Riga, Monroe Co., deceased, to-wit: SALLY ANN WAFUL and CHARLES WAFUL. Named his second daughter: CATHERINE COCKERTON. Named his third daughter, MARIA COMSTOCK. Named his eldest son, JOHN C. STAGE. Named his second son, HEMAN E. STAGE. Named his third son, HENRY C. STAGE. Named his fourth son, NICHOLAS STAGE, JR. He directed Maria to fulfill to ANNA ELSEY, an Indenture, which he had made and executed to her. Named Maria as executrix. Will dated 15 June 1841. /s/ Nicholas X Stage.
Witnesses: JEREMIAH HODGE, STEPHEN P. RUSSELL, both of Theresa, and JASON CLARK of Plessis, NY.

NOTE: Nicholas Stage died on 4 July 1841 at 62 years, 6 mos; buried Redwood Cemetery in Theresa. Medad Comstock, husband of Maria Stage, was born 22 August 1796 in Williamstown, Berkshire, MA; he was the son of MEDAD COMSTOCK and EUNICE ELIZABETH LAMB. Medad Jr. married ABIGAIL BELINDA WOODWORTH in 1820 in Oneida Co., NY and married Maria Stage on 20 March 1826 in Galena, Jo Daviess Co., IL. He died in 1851 in California.
