On 22 August 1849, BURNET V. SMITH of Ellisburgh, petitioned to open probate and that he and ROSWELL KINNEY were the executors named in the will.

That the said Eunice E. Wood and Mary L. Brewster were minors and that Roswell Kinney of Ellisburgh, NY was their general guardian.
WILL OF TIMOTHY BREWSTER
TIMOTHY BREWSTER named his sons: EPHRAIM, ELISHA and WILLIAM. Named his children: EPHRAIM BREWSTER, ASENATH SMITH, HANNAH BARNES, ELISHA BREWSTER, WILLIAM BREWSTER, ANNA DOOLITTLE. And ROBA BREWSTER and BARNET V. SMITH (who has been brought up in my family and with me from the age of six years). Appointed his son, ELISHA BREWSTER and friend, BURNET V. SMITH as executors. Stated that his son, ELISHA BREWSTER had deceased since he wrote his will and appointed ROSWELL KINNEY of Ellisburgh as an executor replacement for the will. The wearing apparel that was to go to his son, Elisha, was to be given to Burnet V. Smith. Dated: 1 February 1847. /s/ Tim Brewster
