In the matter of the estate of WHEATON EARL of Rutland, Jeff. Co., NY: On 30 July 1855, ALCENA EARL of Rutland petitioned to open probate.

ALTHEA MARIA EARL, child of testator, of Rutland, all minors having no general guardian
ALCENA EARL, of full age, widow of testator

WILL OF WHEATON EARL-

WHEATON EARL named his wife, ALCENA EARL. Named the mother of his wife, MERCY EARL. Mentions a certain instrument in writing executed by the said MERCY EARL and DANFORD EARL, his father, to him, dated May 26, 1836. Mentions that his youngest child was ALTHEA MARIA EARL. Named his children: HELEN A. EARL, JANE A. EARL, DELIA A. EARL, AMY C. EARL, ADA ALCENA EARL and ALTHEA MARIA EARL. Appointed wife Alcena Earl as sole executrix. Will dated 13 April 1855.

NOTE: The will named Mercy Earl as the mother of Wheaton's wife, Alcena. However, he then mentions a document written by Mercy Earl and Danford Earl, his father. It seems likely that it was a transcription error in the will and that Mercy Earl was the mother of Wheaton.
