Comstock deceased, all of the county and sate aforesaid of rhte first part, and THOMAS C. SLAID of LeRay aforesaid of the second part witnesseth Whereas a petition was heretofore presented to the county court of Jefferson Co., state of NY by Charlis G. Harger, Executor and Jane M. Comstock, executrix of the last will and testament of William G. Comstock deceased, setting forth amongst other things that the said William G. Comstock departed this life on or about the third day of June 1851leaving his last will and testament appointing said petitioners executors thereof which has been duly proved and recorded and Letters Testamentary duly issued to them and that the above named John M., William W., Emma H., Clarence and Charles G. Comstock are the heirs at law of the said deceased and the said Jane M. Comstock is widow of the said deceased and that the said heirs are all except the said John M. Comstock, under the age of twenty-one years having no general guardian that the said William G. Comstock died seized in fee of the equal undivided half of the lands and premises hereinafter described and Ira A. Smith was seized in fee of the other undivided half thereof. That said premises were at the time of the decease of the said William G. Comstock subject to a contract for the sale thereof to Thomas C. Slaid, executed by the said Ira A. Smith and said William G. Comstock in his lifetime in and by which it was agreed that said premises should be conveyed to the said Thomas C. Slaid upon the payment of the sum of money therein mentioned which sum has been paid and said Slaid entitled to a conveyance of said land and praying that the said petitioners or some other competent person might by the order and decree of the said court be authorized to perform on behalf of and for the aforesaid infant heirs of the said William G. Comstock, deceased, the said contract which said deceased was bound to perform and to make conveyance to the said Thomas C. Slaid of the right, title and interest of the aforesaid infant heirs of in and to the aforementioned lands and premises and for the specific performance of the said contract by the heirs at law of the said deceased. And whereas such proceedings were afterwards had in the said court upon the said petition that by an order of the said court duly made on the 12th day of February was referred to Lysander H. Brown, Esq. To ascertain and report to said court as to the truth of the facts stated in said petition. And it was further ordered by the said Court that Silas W.
