On 15 March 1845, FOSTER D. HARVEY petitioned to open probate; he stated that Abel had lately died and left a will and had named POLLY HARVEY, executrix.

WILL OF ABEL HARVEY
ABEL HARVEY named his wife, POLLY. Named daughter, EMELINE. Named his two children: FOSTER D. HARVEY and EMELINE HARVEY. Abel appointed his executor and guardian of the minor child, wife Polly. Appointed his friend, JOHN DRESSER, as executor and trustee of his estate. Will dated: 30 October 1844.
Witnesses: CRAFTS P. KIMBALL of Rutland and HENRY SEARS of Watertown, NY
Will proved: 25 March 1845.
