On 22 May 1841, ELIHU MORTON McNEIL of Henderson, petitioned to open probate on the estate. Named executors were ELIHU MORTON McNEIL and WILLIAM McNEIL. Ansel had deceased on 29 April 1841.

MARY McNEIL, widow of the deceased
DANIEL McNEIL, father of the deceased
WILL OF ANSEL McNEIL
ANSEL McNEIL named his wife, MARY. If she remarried one-half of a third of the two thirds given to her he gave to the children of his beloved brother, MORTON McNEIL. Named his adopted daughter, JOSEPHINE McNEIL. Mentioned the natural children of his brother, Morton McNeil, but not by name. Appointed his two brothers, WILLIAM McNEIL and MORTON McNEIL as executors.
