In the matter of the estate of AZARIAH WALTON of Alexandria, NY:

On 18 June 1855, CHARLES WALTON of Alexandria, filed the petition to open probate and stated that Azariah had deceased and made a will and codicil. Charles, one of the executors of the will named the heirs.

CHARLES WALTON, son and petitioner and executor
DAVID B. WALTON of Alexandria
SARAH HAMBLEN, wife of ALEXANDER C. HAMBLEN of Lyme, NY
MARY WALTON of Alexandria
JANE WARD, wife of DELOS L. WARD of Theresa
JOHN F. WALTON of Alexandria, all of full age.
WRIGHT BENTON WALTON of Alexandria, a minor having no general guardian and all children of deceased Azariah.
GEORGE W. WALTON
HARRIET WALTON both of Philadelphia, NY, minors with no general guardian and grandchildren of Azariah.
MARY WALTON of Alexandria, is of full age and the widow of the deceased.

WILL OF AZARIAH WALTON

AZARIAH WALTON named his wife, MARY WALTON. JOHN F. WALTON, CHARLES WALTON and WRIGHT BENTON WALTON were to provide a cow and $200 every year of Mary's life as rent of the store, storehouses and wharf and lot which was given to them by will. Named three sons: CHARLES WALTON, JOHN F. WALTON and WRIGHT BENTON WALTON. Named his daughter, MARY G. WALTON. Named two grandchildren: GEORGE WRIGHT WALTON and HARRIET WALTON. Named granddaughter, ANNE WALTON or to the heirs of son, D. B. WALTON. Named his daughter, JANE E. WARD. Named his daughter, SARAH S. HAMBLIN. Mentioned BENTON and WILLIAM S. HAMBLIN for what they owed and which Azariah considered had gone into the hands of A. C. HAMBLIN. Named his son, DAVID B. WALTON what he owed and what he owed to the firm of CORNWALL and WALTON. Forgave amounts owed from CHARLES WALTON and SILAS S. WARD. Appointed his two sons. CHARLES WALTON and JOHN F. WALTON as executors. Will dated 5 May 1855. /s/ Azariah Walton. Witnesses: ANDREW CORNWALL and CHAUNCEY WESTCOTT both of Alexandria.

CODICIL: On 25 May 1855, Azariah created a codicil. In the early will each child had been given 1/7 of the estate whereas the codicil changed the ratio to 1/6 part of the balance for Charles Walton, John F. Walton, Wright Benton Walton, Mary Walton and Jane E. Ward, including also Sarah Hamblin who was to receive 1/6 part. /s/ Azariah Walton Witnesses: ANDREW CORNWALL and CHAUNCEY WESTCOTT of Alexandria Will proved: 2 July 1855
