On 17 February 1861, Benjamin F. Hawes of Ellisburgh, petitioned to open probate.

George W. Hawes of Orleans, Jeff. Co.
Abigail Wilson, wife of William Wilson of Lorraine, all of Jefferson Co., NY
Betsey Bailey, wife of Alexander Bailey of North Salem, Wisconsin
Laura Reed, wife of Solomon Reed of Milford, Wisconsin, all children of the deceased except Lucinda Hawes,
Emery O. Boomer, Mary Jane Rice, wife of Oren Rice of Henderson, Jeff. Co., and Truman H. Boomer of Stevens Point, Wisconsin and Andrew B. Boomer of Urbana, Illinois, children of Polly Boomer, a deceased daughter of Ebenezer Hawes, the deceased, all said heirs and next of kin being of full age.
Ebenezer named his wife, Lucinda Hawes. He named his daughter, Abigail Hawes. Named his daughter, Laury Reed. Named his son, George W. Hawes. Named his daughter, Betsey L. Bailey. Named his son Benjamin Franklin Hawes. He appointed wife Betsey and son, Benjamin F. Hawes, as co-executors of the will.
Will dated 19 May 1856. /s/ Ebenezer Hawes
Witnesses: Alonzo Maxon and Paul C. Maxon both of Adams, Jeff. Co., NY
Whereas, Ebenezer Hawes of Ellisburgh and late of the town of Lorraine in Jeff. Co., And whereas at that time I was the owner of the undivided one half of the farm on which I then resided in Lorraine, it being the same farm referred to in the foregoing will. And whereas having sold the same and purchased the equal undivided half of the farm of about 100 acres of Thurstin Baker, it being the same on which I now reside in Ellisburgh aforesaid. Therefore, be it known to all who it may concern that the object of this codicil is to substitute the farm on which I now reside for the one referred to in the foregoing will...the sixty dollar bequeathment to my son George W. Hawes has been paid and he has no further interest in this will.
Dated this 17th day of March 1859 in the presence of J. W. Persons and William Hunter. /s/ Ebenzer Hawes.
