On 10 April 1849, SAMUEL D. GARDNER of Lorraine petitioned to open probate and had left a will in which Samuel had named him and LUCY GARDNER as executors.

Samuel Gardner, Phebe R. Gardner, Sallena Gardner, Cyrus Gardner were all minors having no general guardian in the state.
