On 12 June 1846, HENRY F. SEWALL of Brooklyn, NY petitioned to open probate and Henry had appointed him and JOHN G. SEWALL, EDMUND SEWALL and TOLCOTT H. CAMP as executors.

HENRY D. SEWALL appointed HENRY DEVEREAUX SEWALL as executor. Mentioned his late wife, MARY CATHARINE NORTON by virtue of an agreement made on 25 August 1819 between her and her husband of one part, and FREDERICK W. NORTON of the other part, empowered to make a testamentary disposition of all her property and estate devised to her by her father, the late BIRDSEY NORTON, the day before her decease, to wit, on 29 December 1840, did make and publish her last will and testament, in and by which, with Henry's consent, she appointed and disposed of all her said estate real and personal. And whereas, by the said last will of his wife, she devised and bequeathed to Henry the use and income of her estate during the minority of all her children and further authorized Henry to appoint by will all her said estate among her children in such portions, on such conditions and in such manner as Henry might think discreet...Henry continued with his own will and disposed during the minority of all his children. He named his minor children: EDMUND QUINCEY, FRANK DEVEREAUX and WALTER DEVEREAUX, when they reached majority. Named the brother of the children, HENRY and their sister, MARY. Named daughter, ANN ELIZABETH. Named his son, JOHN GULLISON and EDMUND QUINCEY. Named his son, FRANK DEVEREAUX. HENRY DEVEREAUX SEWALL was to dispose of Henry's personal estate; he mentions specific items and which child should receive them accordingly. Several items had been given to Henry by his father, including law books. He appointed HENRY FOSTER, JOHN GULLISON and EDMUND QUINCEY with his friend, TOLCOTT H. CAMP as executors.
