In the matter of the estate of SAMUEL SPENCER of Ellisburg, Jefferson Co., NY:
On 24 November 1838, SAMUEL NORTHRUP, executor of the will petitioned to open probate. S. C. CHITTENDEN of Adams stated that on 17 October last he endorsed the annexed citation in a letter to WILLIAM S. BISHOP, ESQ., of Rochester, with instructions to save it in the widow of EDWARD PENNEY, deceased, residing in the place and obtain her admission of service and return it to the deponent. That AMANDA PENNEY had agreed to service dated 20 Oct. 1838.

On the 9th instant, he directed his son, JAMEA, of age 15, to go and make service of the citation on DANIEL SPENCER JR. on the same day.
WILL OF SAMUEL SPENCER
SAMUEL SPENCER named his wife, POLLY. He named daughter, MARIA SPENCER. He named his brother, STEPHEN SPENCER and his two sisters, AMANDA PENNEY and ALMIRA BARNEY. Named his father, DANIEL SPENCER. After Polly's death, from estate proceeds, suitable grave stones for himself and wife and for his father and mother: DANIEL and SUSANAH SPENCER, and for his brother, HENDERSON SPENCER, and sister, ELISABETH SPENCER. Also, one set for his daughter, MARIA SPENCER. He appointed EDMUND M. ELRIDGE sole executor. Will dated: 25 April 1835. /s/ Samuel Spencer
